Default Brake pedal touching the steering UJ when fully pressed

In case anyone else has this problem here's the answer from Terry & Mark at Marlin:

"No its not a problem you can just bend the pedal slightly to move it away or send us the pedals back and we can supply them shortened form top to bottom first. Then you fit them possibly still needing to impart a slight re-alignment bend.
